What is Chapter 7?
The main difference between a Chapter 7 and a Chapter 13 bankruptcy is that a Chapter 13 bankruptcy involves a repayment plan for your debt, while a Chapter 7 bankruptcy eliminates most debts. Chapter 7 will not, however, discharge debt involving alimony, child support, student loans or criminal fines.
Chapter 7 is also known as liquidation bankruptcy. While it erases the majority of your debts, you may have to relinquish some of your property to the bankruptcy court for liquidation (sale).
We can help you determine if you qualify for Chapter 7 bankruptcy and whether it may be the best option for you.
Through Chapter 7, we may be able to help you discharge debts like:
- Unsecured credit card debt
- Medical bills
- Back rent
- Utility bills
- Personal loans
- Back income taxes (in certain circumstances)
You may be able to keep your home and your car under Chapter 7, depending on several factors including the market value, the amount of equity you have and how much you still owe. If Chapter 7 is not the best option for you or you do not qualify, we can help you file for Chapter 13.
